Collectible Purpose Only – All swords, katanas, and related items are sold strictly as collectible and display items.
Not Intended for Combat – Even if functional (e.g., full tang, sharpened), products are not certified for combat, sparring, or defense. Such use is misuse and entirely at the buyer’s risk.
Assumption of Risk – Handling bladed items carries inherent risks. By purchasing, you voluntarily assume all risks, including injury, property damage, or death.
Age Restriction – Purchasers confirm they are at least 18 or the legal age of majority. Products must be kept away from minors.
Legal Compliance – Customers are solely responsible for complying with all applicable laws. Katana Corp disclaims all liability for legal consequences.
No Liability for Misuse – Katana Corp shall not be liable for harm, injuries, or damages resulting from misuse, abuse, or mishandling.

SECTION 7 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may refuse or cancel orders at our discretion, including orders under the same account, card, or address. You agree to provide accurate billing and promptly update information to complete transactions.

SECTION 8 – OPTIONAL TOOLS

We may provide access to third-party tools, apps, or APIs “as is” without warranties. We do not monitor or control such tools and disclaim liability for damages arising from their use. You assume all risks in using third-party integrations, including SEO apps, review systems, or payment gateways.

SECTION 15 – LIMITATION OF LIABILITY FOR DEFECTS

No product is guaranteed to be unbreakable. Even quality blades may fail if misused.
To the fullest extent permitted by law, Katana Corp disclaims liability for injuries or damages caused by product breakage, defects, or blade detachment.
In case of manufacturing defect, sole remedy is replacement or refund, provided the item is unused and returned under our Refund Policy.

SECTION 16 – LIMITATION OF LIABILITY (GENERAL)

Katana Corp, its affiliates, directors, employees, and suppliers shall not be liable for injuries, damages, or losses of any kind, including incidental or consequential damages, arising from use of products or services. Liability is limited to the maximum extent permitted by law.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Katana Corp, its affiliates, officers, employees, and suppliers against all claims, damages, liabilities, or expenses (including attorneys’ fees) arising from misuse of products, breach of Terms, or violation of law.

SECTION 18 – SEVERABILITY

If any provision is found unlawful or unenforceable, the remaining provisions shall remain valid and enforceable.

SECTION 19 – TERMINATION

These Terms remain effective unless terminated by either party. We may terminate access without notice if you fail to comply. Obligations incurred prior to termination shall survive.

SECTION 20 – ENTIRE AGREEMENT

These Terms, along with policies posted on our site, constitute the entire agreement, superseding prior agreements. Any ambiguities shall not be construed against Katana Corp.

SECTION 21 – GOVERNING LAW

These Terms and related agreements shall be governed by the laws of Hungary, without regard to conflict-of-law principles.

SECTION 22 – DISPUTE RESOLUTION AND ARBITRATION

a) EU/UK Consumers.
For customers residing in the European Union or the United Kingdom, nothing in these Terms shall deprive you of your mandatory statutory rights, including the right to bring proceedings before your local courts.

b) Arbitration for Non-EU/UK Customers.
For all other customers, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased from Katana Corp shall be resolved exclusively by binding arbitration administered by the Hungarian Chamber of Commerce and Industry (or another recognized arbitral institution).

The seat of arbitration shall be Budapest, Hungary.

The arbitration shall be conducted in English, unless otherwise mutually agreed.

c) Class Action Waiver.
To the fullest extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.

d) Low-Value Claims Exception.
Either party may choose not to arbitrate if the value of the claim is less than EUR €2,000. In such cases, the claim may instead be brought before a competent court of the customer’s local jurisdiction.
The EUR value shall apply as reference currency; for other currencies, the applicable amount shall be converted using the official European Central Bank exchange rate on the date the claim is filed.

e) Arbitration Costs.
Arbitration costs will be kept reasonable and proportionate to the value of the claim.
Unless otherwise required by law, each party shall initially bear its own costs. The arbitrator may reallocate fees in the final award in a fair and equitable manner, taking into account the circumstances of the case.
